At second attempt the Parliament overrode the President’s veto on land sale moratorium

 

At today’s plenary session the Verkhovna Rada of Ukraine adopted again the Law “On Introduction of Changes into Items 14 and 15 of Chapter X “Transitory Provisions” of the Land Code of Ukraine (about term for land plots sale)”. This decision was supported by 366 MPs of Ukraine. The legislative act (registration number 3425) stipulates that till enforcement of laws on the state land cadastre and on the land market, but no later than 2012, introduction of right for a land parcel (share) to statutory funds of economic associations shall be banned.

The law also stipulates that till enforcement of laws on the state land cadastre and on the land market, but no later than 2012, it shall be banned:

purchase-sale of land plots of agricultural purpose of the state and communal ownership, but for their withdrawal (redemption) for public needs;

purchase-sale or alienation of land plots in another manner and change of target purpose (use) of land plots owned by citizens and legal persons for farm market agriculture; of land plots, allotted actually (afield) to owners of land parcels (shares), but for their inheritance, change of a land plot for another land plot in compliance with law and withdrawal (redemption) of land plots for public needs.

In line with the law “purchase-sale or alienation of land plots and land parcels (shares) in another manner, defined in sub-items “a” and “b” of this item, shall be introduced on condition of enforcement of laws on the state land cadastre and on the land market, but no later than 1 January 2012, setting peculiarities of flow of lands of the state and communal property and lands of farm market agriculture”.

It is envisaged that agreements (including letters of authority) concluded in the period of prohibition of purchase-sale or alienation of land plots and land parcels (shares) in another manner, defined in sub-items “a” and “b” of this item, in what relates to their purchase-sale or alienation in another manner, as well as in what relates to transfer of right for alienation of these land plots and land parcels (shares) for the future shall be invalid immediately after their conclusion (certification).

As we informed earlier, the President of Ukraine Viktor Yushchenko vetoed law on extension of land sale moratorium. In line with part two of Article 94 of the Constitution of Ukraine the head of the state returned the law with his propositions to the Verkhovna Rada for reconsideration.
